Terms of Service

You must be at least 18 years old and legally able to enter binding contracts to use Drop Candy. By using the Service you confirm this is true.

You are responsible for maintaining the security of your account and all activity that occurs under it. Notify us immediately at legal@dropcandy.ai if you suspect unauthorised access.

Paid subscribers: You own all images generated through the Service to the fullest extent possible under applicable law. This includes commercial use.

Free tier users: Images generated on a free plan are owned by Drop Candy and licensed to you under the Creative Commons Attribution-NonCommercial 4.0 International License. You may not use free-tier outputs for commercial purposes.

Note: AI-generated images may have limited copyright protection under applicable law. "To the fullest extent possible" reflects this legal uncertainty, which is not unique to Drop Candy.

By uploading content or generating images through the Service, you grant Drop Candy a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely to provide and operate the Service. We do not use your uploaded images or generated outputs to train our own AI models. Your data may be processed by third-party AI providers as part of delivering the Service, and their use of data is governed by their own terms and privacy policies.

By uploading any content you warrant that:

• You own it or have all necessary rights and permissions to use it
• The products shown are genuine goods you own, produce, or are authorised to represent — not counterfeit, infringing, or unauthorised replicas of third-party brands
• Your content does not violate any applicable law or third-party rights
• You will not upload content containing sensitive personal data of others without their consent

You may not use Drop Candy to:

• Upload or generate content involving minors in any sexual, exploitative, or inappropriate manner
• Impersonate any person, brand, or organisation, or create content intended to deceive
• Facilitate the sale or promotion of counterfeit goods or infringe third-party intellectual property rights
• Upload or generate explicit pornography, graphic gore, or content that is hateful, abusive, or harassing
• Violate any applicable local, national, or international law
• Attempt to reverse-engineer, scrape, or abuse the Service or its underlying AI systems
• Use the Service for any purpose that competes directly with Drop Candy without our prior written consent

Drop Candy uses third-party AI providers to generate images. These providers process your uploaded content and prompts subject to their own terms and privacy policies. We prefer to work with providers who do not use customer data for model training, but we cannot guarantee their practices. We encourage you to review the privacy policies of the third-party providers we use, which are listed on our Privacy Policy.

Our AI partners apply their own content filters that may decline to generate certain images even when those images would otherwise be permitted under Section 6. These filters operate at the AI provider level and are outside our control.

Common reasons an image may be declined include, but are not limited to:

• Identifiable real people, including faces of public figures or private individuals
• Brand logos, trademarks, and other protected third-party intellectual property
• Weapons, drugs, or other regulated items
• Suggestive, violent, or otherwise sensitive scenes
• Content the AI provider classifies as risky for any other reason, including false positives

When an image is declined for these reasons, no credit is consumed for that generation in most cases. Repeated attempts on the same source content may not be refunded. If you believe an image is being declined incorrectly, try a different source photo or angle.

Drop Candy generates images at high volume. Because many users create similar styles and products, your outputs may resemble images generated for others. We do not guarantee exclusivity of any generated content.

Drop Candy provides the Service as a tool. We do not review, approve, or endorse the content you upload or generate. You bear full responsibility and all legal risk for ensuring your use of the Service — including uploaded content and generated outputs — does not infringe any third-party copyright, trademark, trade dress, or other intellectual property rights. Drop Candy will not defend or indemnify you against any such claims.

Drop Candy makes no representation that any generated output is cleared for commercial or any other use with respect to third-party trademarks, brand names, logos, or intellectual property. If you do not own or have explicit clearance to use any trademark, brand, or intellectual property that appears in a generated image — whether intentionally or as a result of AI generation — you are solely responsible for obtaining the necessary rights before any use. Drop Candy accepts no liability in this regard.

The Service is provided "AS IS" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that generated outputs will be accurate, unique, or suitable for any particular use.

Drop Candy uses artificial intelligence to generate images. AI systems can produce unexpected, inaccurate, or unintended results. Generated outputs may inadvertently include elements that resemble real logos, trademarks, brand identifiers, or other protected third-party content. We do not review generated outputs for intellectual property clearance. You are solely responsible for reviewing all generated content before any commercial or public use, and for ensuring such use does not infringe third-party rights.

While Drop Candy strives for high-quality results, we do not guarantee that any individual generation will meet your specific requirements, aesthetic standards, or intended use. Results may vary based on uploaded content, selected styles, and the inherent unpredictability of AI systems.

No IP indemnification. Drop Candy does not provide copyright or intellectual property indemnification of any kind. If a generated image is alleged to infringe a third-party copyright, trademark, or other intellectual property right, you bear all legal risk and costs associated with that claim. Drop Candy will not defend, indemnify, or hold you harmless in connection with any such claim.

No federal copyright guarantee. Ownership of generated outputs granted under Section 3 is contractual — it governs the relationship between you and Drop Candy. It does not guarantee federal copyright protection. The U.S. Copyright Office does not currently extend copyright to purely AI-generated images without sufficient human creative input. This means a third party who copies your generated image may not be infringing a federally enforceable copyright. Drop Candy makes no representation that your generated outputs are eligible for or protected by federal copyright law.

You agree to defend, indemnify, and hold harmless Drop Candy, its affiliates, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) content you upload; (c) your violation of these Terms; or (d) your infringement of any third-party rights.

All payments are final and non-refundable except where required by law. Subscription fees renew automatically unless cancelled prior to the renewal date. You are responsible for cancelling your subscription before the next billing cycle if you do not wish to be charged.

Upon cancellation, your access to paid features continues until the end of your current billing period. No prorated refunds are issued for unused time within a billing cycle.

Unused image credits do not carry over between billing cycles and are forfeited upon cancellation or plan expiry.

We may modify, update, or discontinue any part of the Service at any time without liability. We will endeavour to provide reasonable notice of material changes where possible.

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a notice to legal@dropcandy.ai including:

• Identification of the copyrighted work
• Identification of the allegedly infringing content
• Your contact information
• A statement of good faith belief that the use is not authorised
• A statement, under penalty of perjury, that the information is accurate and you are authorised to act

We will respond to valid notices promptly. Misrepresentation of infringement may result in liability under DMCA Section 512(f).

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if continued access poses a risk to the Service, other users, or third parties. You may cancel your account at any time.

We also reserve the right to close accounts, discontinue access, or refuse service to any user at our sole discretion.

Cancelling your subscription: visit Account → Plan → "Manage subscription" to cancel or change your plan at any time through our billing portal.

Deleting your account and data: to permanently delete your account and all associated data, email support@dropcandy.ai from the address on file. We will complete the deletion within a reasonable timeframe and confirm once done.

To the maximum extent permitted by law, Drop Candy's total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 6 months preceding the claim.

We are not liable for delays or failures caused by events outside our reasonable control.

These Terms are governed by the laws of the State of Delaware. Any disputes shall be resolved by binding arbitration in Wilmington, Delaware, except where prohibited by law.

All model imagery generated by Drop Candy is created entirely by artificial intelligence under the creative direction of our team. Any resemblance to real persons, living or dead, is purely coincidental and unintentional.

We do not guarantee that generated content will be unique or free from similarities to real individuals, brands, or other third-party content.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance.
